The accident term is also the justification for not guilty by reason of insanity. The idea being that the brain of the person is so messed up that no conscious choice can be made. I am not a fan.

I totally get what you're saying. Isn't that manslaughter though? But in this instance the guy was running around with a machete in people's back gardens looking for anything living to decapitate. Insane or not, he murdered someone with the sole intent of ending life. I just think that a "not guilty of murder..." verdict is an insult to the victims family.
I have problems with the death penalty as well. I have worked with sex offenders in an institution and know they cannot be rehab'd.
They should NEVER be out in public again!! Let them rape one and other all they want.
I also think ALL prisoners should work long hard labor hours, grow and cook their own food. Not be allowed internet, to earn degrees but to be punished in prison.
I think we incarcrate too many people who are insane and our mental health care is broken. People many times tell someone they need help and may kill someone or themselves and our mental health system says to wait 1-3 months before being seen by a do health care provider. It is bullshit to kill someone for a mental illness! Instutions were better than just setting folks on the street. They do ask for help but our society does not listen.
Also our prisons are full of drug adicts, they need rehab not incarceration. We need to just legalize marijuana in this country and stop filling prisons with those who sell or smoke it. They are in prison longer than many murders and sex offenders. We can tax the pot and help our countries debt, look at Colorado.
I just think the real criminals need to be in jail. Our system is broken, we do kill the wrong people and don't help those who need it.
